By accessing or using BidBary (bidbary.me and associated services), you agree to be bound by these Terms of Use. If you do not agree, please do not use the platform.

These terms apply to all users — attendees, organizers, and visitors. Additional terms may apply to specific features such as auction mechanics, organizer payouts, or enterprise accounts.

BidBary reserves the right to update these terms at any time. Continued use of the platform after changes are published constitutes acceptance of the revised terms. Material changes will be communicated by email to registered users at least 14 days in advance.

To use BidBary, you must be at least 16 years of age. By creating an account, you confirm that all information you provide is accurate, complete, and up to date.

You are responsible for maintaining the confidentiality of your login credentials. BidBary is not liable for any loss or damage arising from unauthorised access to your account.

One account per person. Creating multiple accounts to circumvent limits, bans, or verification requirements is prohibited and may result in permanent suspension of all associated accounts.

Organizer accounts require successful identity verification before publishing paid events. BidBary may request additional documentation at any time.

As an organizer, you are solely responsible for:

• The accuracy, legality, and fulfilment of the events you list
• Obtaining all required permits, licences, and insurance for your events
• Accurately representing event details including date, time, location, capacity, and ticket terms
• Honouring all ticket sales, refund policies, and attendee commitments stated on your event page
• Complying with all applicable local laws governing events, ticketing, and data protection

If you cancel an event, you must notify BidBary and all ticket holders immediately. BidBary will issue automatic refunds and may charge a cancellation fee depending on your plan and the notice period given.

BidBary is a platform, not a co-organizer. We do not endorse or guarantee the quality of any event listed.

As an attendee, you agree to:

• Provide accurate personal information when registering and checking in to events
• Not share, resell, or transfer tickets unless the organizer explicitly permits it
• Comply with the event organizer's rules and venue policies
• Not use multiple accounts to gain unfair advantage in bidding or ticket allocation
• Treat other users, organizers, and staff respectfully on the platform

Fraudulent ticket claims, chargebacks without valid cause, or abuse of the invite-only request system may result in account suspension.

Payments: All ticket purchases are processed securely through our payment partners. Prices are shown inclusive of applicable platform fees. Multi-currency support is provided where available.

Refunds: Refund eligibility is determined by the organizer's stated refund policy, displayed on each event page before purchase. BidBary enforces automatic full refunds in the following cases: organizer-initiated event cancellation, material misrepresentation of an event, or verified fraudulent organizer activity.

Disputes: If you have a dispute about a purchase, contact BidBary support within 30 days of the event. We will mediate between you and the organizer and issue a decision within 10 business days. Chargebacks initiated before contacting BidBary support may result in account suspension.

Organizer Payouts: Proceeds are paid to organizers 3–5 business days after event completion. BidBary deducts the applicable platform commission before disbursement.

When participating in auction events, the following rules apply:

• All bids are binding. Placing a bid is a commitment to pay if you win
• The highest bid at auction close wins, provided it meets or exceeds the reserve price
• If no bid meets the reserve price, the organizer may choose not to sell
• Bid manipulation (shill bidding, coordinated bidding, or bid retraction) is strictly prohibited
• BidBary reserves the right to void bids and suspend accounts where manipulation is suspected

Winning bidders will be automatically charged the winning bid amount. Failure to complete payment within 24 hours may result in forfeiture of the winning bid and temporary suspension from auction events.

The following activities are strictly prohibited on BidBary:

• Listing fraudulent, misleading, or non-existent events
• Collecting payments for events that will not take place
• Scraping, crawling, or bulk-extracting platform data without written permission
• Attempting to reverse-engineer or circumvent BidBary's systems
• Harassment, hate speech, or discrimination toward any user
• Impersonating another person, organisation, or BidBary staff
• Using BidBary to facilitate illegal activities of any kind
• Creating fake reviews, inflating ratings, or manipulating trust signals

Violations may result in immediate account suspension, legal action, and forfeiture of funds held in escrow.

All BidBary branding, logos, product design, and original content are owned by BidBary Technologies and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from BidBary's intellectual property without express written permission.

As an organizer, you retain ownership of the content you publish (event descriptions, images, etc.). By listing on BidBary, you grant BidBary a non-exclusive, royalty-free licence to display, reproduce, and promote that content on the platform and associated marketing channels.

If you believe your intellectual property has been infringed on BidBary, contact legal@bidbary.me with full details of the claim.

BidBary is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation of the platform.

BidBary is a marketplace and is not responsible for the actions, omissions, or content of organizers. We do not co-host or co-produce any event listed on the platform.

To the maximum extent permitted by law, BidBary's total liability to any user shall not exceed the amount paid by that user to BidBary in the 12 months preceding the claim.

BidBary is not liable for indirect, incidental, consequential, or punitive damages arising from use of the platform.

You may close your account at any time from your profile settings. Outstanding balances, pending payouts, or active ticket commitments must be resolved before account closure.

BidBary may suspend or permanently terminate your account at any time, with or without notice, if you violate these terms, engage in fraudulent activity, or if required by law.

Upon termination, your right to access BidBary ends immediately. Data retention policies (see Privacy Policy) continue to apply.

These Terms of Use are governed by and construed in accordance with the laws of the Republic of Azerbaijan, without regard to conflict of law principles.

Any disputes arising from these terms or your use of BidBary shall be subject to the exclusive jurisdiction of the courts of Baku, Azerbaijan, unless mandatory local law provides otherwise.

If you are accessing BidBary from the European Union, your statutory rights under EU consumer protection law are not affected by these terms.

BidBary may update these Terms of Use from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify registered users by email at least 14 days before changes take effect
• Display a prominent banner on the platform for 30 days following the change

Your continued use of BidBary after the effective date of any changes constitutes your acceptance of the revised terms. If you do not accept the changes, you must discontinue use and close your account before the effective date.
